eBay: Prepare for Online Dispute Resolution (ODR)
Online dispute resolution (ODR) is an online equivalent of Alternative Dispute Resolution (ADR), a collection of processes and techniques used to settle disputes without litigation. The ODR website lists dispute resolution bodies that offer out-of-court settlement procedures. All have been checked to make sure that they meet European Union standards and are registered with national authorities.
When two parties are disputing an online transaction they may refer to the ODR Platform to settle the matter out-of-court, at which point both parties have to agree on which dispute resolution body they are going to use.
Your obligations as an eBay seller
As of February 15, 2016, sellers have an obligation to refer customers to the Online Dispute Resolution (ODR) Platform.
According to article 14, section 1 of Regulation (EU) No 524/2013 all businesses selling goods or services online within the EU must carry the following link on their website to the ODR Platform: http://ec.europa.eu/consumers/odr/
What should I do with my eBay items?
Your eBay items should include the link in any of the following locations:
- Item description
- Impressum / Terms and Conditions (My eBay)
